Welcome to GenImg. These Terms and Conditions ("Terms") govern your use of the GenImg mobile application (the "App") developed and operated by GenImg ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using GenImg, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you must not use the App.

2. User-Generated Content & Conduct

2.1 Prohibited Content

You agree not to use GenImg to generate, upload, or distribute content that:

  • Is illegal, obscene, or sexually explicit (NSFW).
  • Constitutes or facilitates the creation of deepfakes — realistic but fabricated images of real individuals without their consent.
  • Promotes violence, hatred, discrimination, or harassment against any individual or group.
  • Infringes on the intellectual property rights of others.
  • Contains malware, viruses, or any harmful code intended to disrupt the App or its users.
  • Impersonates any person or entity, or falsely states or misrepresents your affiliation with any person or entity.

2.2 Account Termination & Content Removal

We have a zero-tolerance policy for objectionable content and abusive users. We reserve the right to suspend or permanently terminate your account, without prior notice, if you violate these Terms. This includes, but is not limited to, abuse of the credit system, attempting to reverse-engineer the App, or engaging in any fraudulent activity.

If you encounter inappropriate content generated by the App or another user, you may report it to bkagravat.apps@gmail.com. We will review all reports and act to remove the offending content and eject the user who provided it within 24 hours.

2.3 Content Filtering & Moderation

To maintain a safe environment, GenImg utilizes automated filtering mechanisms to block prompts that attempt to generate prohibited, illegal, or sexually explicit content. Attempting to bypass these safety filters will result in immediate account suspension.

3. Intellectual Property

3.1 Your Content

Images you generate using GenImg are yours. We grant you a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and distribute the images you create through the App for any lawful purpose, including commercial use.

3.2 Our Platform

The GenImg app, including its design, code, algorithms, logos, and branding, is the intellectual property of GenImg and is protected by copyright and trademark laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

3.3 Third-Party IP Disclaimer

AI-generated images may inadvertently resemble existing copyrighted works, trademarks, or the likeness of real individuals. GenImg is not liable for any intellectual property infringement that may arise from your use of AI-generated content. It is your sole responsibility to ensure that your generated images do not infringe on any third-party rights before commercial or public use.

4. Subscriptions & Credits

4.1 Payment Processing

All payments, subscriptions, and refunds are handled entirely by Apple through the App Store. GenImg does not process payments directly and cannot issue manual refunds. To request a refund, please visit reportaproblem.apple.com.

4.2 Subscription Plans

GenImg offers the following auto-renewable subscription tiers:

  • Weekly Plan: $4.99/week — 50 credits per billing cycle.
  • Monthly Plan: $19.99/month — 250 credits per billing cycle.
  • Yearly Plan: $99.99/year — 1,500 credits per billing cycle.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel your subscription through your Apple ID settings.

4.3 Credit Policy

  • Plan Credits: Credits included with your subscription plan reset at the beginning of each billing cycle. Unused plan credits do not carry over.
  • Add-On Credits: One-time purchased credit packs do not expire and remain in your wallet until used.
  • Credits are consumed when you use AI features (generation, background removal, upscaling, object erasing). The cost per operation is displayed before confirming each action.

5. Disclaimer of Warranties ("As-Is" Clause)

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose.
  • The accuracy, quality, or reliability of AI-generated content.
  • Uninterrupted, secure, or error-free operation of the App.

AI-generated images may contain artifacts, inaccuracies, or unexpected results (e.g., incorrect anatomy, distorted features). GenImg is not responsible for the quality or suitability of AI-generated outputs for any particular use.

6. Limitation of Liability

To the maximum extent permitted by applicable law, GenImg shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App.
  • Any unauthorized access to or alteration of your content or data.
  • Any third-party content generated through or accessed via the App.

7. Indemnification

You agree to indemnify and hold harmless GenImg, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App and on our website with a revised "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GenImg operates, without regard to conflict of law provisions.
